Oakland Prohibited Food Service Ware

Expanded polystyrene ban, requirement that all takeout food packaging be compostable. Businesses that generate a large portion of litter must pay a litter fee. Title 8.07 of Municipal Code.

Details of regulation: Food vendors are prohibited from providing prepared food to customers in disposable food service ware that uses polystyrene foam. All city facilities are prohibited from using polystyrene foam disposable food service ware and all city departments and agencies will not purchase or acquire polystyrene foam disposable food service ware for use at city facilities. City franchises, contractors and vendors doing business with the city shall be prohibited from using polystyrene foam disposable food service ware in city facilities or on city projects within city limits. Exemptions include prepared foods prepared or packaged outside the city of Oakland, undue hardship, polystyrene foam coolers and ice chests intended for reuse, disposable food service ware composed entirely of aluminum, and emergency situations.

Details of updated regulations: Previous ordinance was updated to include a provision that stipulates no restaurant shall provide a single use beverage

straw to a dine-in customer except on the customer’s specific request. Take-out food orders are exempt from the requirements of this Section 8.09.060. Restaurants may also have single use beverage straws available for use by dine-in customers at locations within the restaurant, including but not limited to self service beverage stations and kiosks.
