Emeryville Food Service Ware Ordinance

Expanded polystyrene ban, requirement that all takeout food packaging be recyclable or compostable.

Details of regulation: Prohibits food providers from providing prepared food to customers in disposable food ware made from polystyrene foam or non-ASTM-Standard compostable plastic. Additionally, all City facilities are prohibited from using polystyrene foam or non-ASTM-Standard compostable plastic disposable food service ware by all City departments and agencies, including events. City franchisees, contractors, vendors, and caterers are prohibited from using polystyrene foam or non-ASTM-Standard compostable plastic disposable food ware. Exemptions include prepared foods that are prepared or packaged outside the City of Emeryville, undue hardship, coolers and ice chests intended for reuse, and emergency situations.

  1. No. 07-004 – An Ordinance of the City of Emeryville Adopting Chapter 14, “Food Service Waste Reduction,” of Title 6 of the Emeryville Municipal Code; and Amending Section 1-2.01(f) of Chapter 2 of Title 1 of the Emeryville Municipal Code Regarding Violations.
